WARREN B. BRAMS: A guardianship is a legal proceeding in which a person or an agency called a guardian is delegated the rights of an incapacitated person called a ward. Guardianship is typically appropriate for incapacitated persons who cannot make their own healthcare decisions or handle their own finances. Guardianship is a court-monitored process. Both a life care plan and budget must be developed for the ward. And then on a yearly basis, the guardian must account to the court. It begins with a legal proceeding to remove an incapacitated person's rights. Additional disputes may concern who should be appointed the guardian or where the ward should live. In an uncontested guardianship, a guardian should be appointed by the court within 30 days of filing of the case. Guardianships are typically billed on an hourly basis. However, some guardianships can be billed as a flat fee. The guardianship should change as the needs of the ward or the guardian change.
